Eligibility and account use

You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to create an account or make purchases on our store. If you are under 18, you may use our website only with the involvement and consent of a parent or legal guardian.

When you create an account, you agree to provide accurate, current, and complete information, and to maintain the security of your login credentials. You are responsible for all activities that occur under your account.

Orders, payments, and pricing

All orders placed through our store are subject to our acceptance. We process customer payments securely using Stripe. You agree to pay all charges incurred by your account at the prices in effect when such charges are incurred, including applicable shipping fees and sales tax calculated by Stripe Tax.

We strive for complete accuracy in product listings, descriptions, and pricing. However, typographical errors or technical glitches may occasionally occur. We reserve the right to correct any pricing errors and to cancel or refuse any orders placed for products listed at an incorrect price, whether or not the order has been confirmed and your payment processed. If your payment has already been processed for a cancelled purchase, we will promptly issue a full refund to your original payment method.

Made-to-order merchandise and custom coloring books

Our physical products—custom coloring posters and custom coloring canvases made from your photo—are made to order through our manufacturing partner, Printful. Because physical items are custom-printed upon receipt of each order, we enforce specific production, shipping, and return policies:

• Order modifications and cancellations: Orders are sent to Printful and confirmed for production automatically as soon as payment succeeds. If you need to change or cancel, email us right away with your order number. We can change or cancel only until Printful starts making it, which can be within a few hours; after that we can’t stop it.
• Shipping: We ship physical merchandise only to addresses within the United States. Shipping timelines and policies are set forth on our shipping page.
• Returns and replacements: Physical items cannot be returned for buyer remorse. If an item arrives damaged, defective, or misprinted, you must notify us within 30 days of delivery with photos to receive a free replacement or refund as detailed on our returns page.
• Custom digital coloring books: Custom coloring books are arranged by quote from custom coloring book via our contact form. After we send a price and delivery date by email and you pay via a secure payment link and email us your photos, we deliver the finished PDF by email only. Refunds for digital books are granted only if the file is technically defective and our support team cannot provide a functioning replacement.

Intellectual property and coloring page license

Our website software, interface designs, logos, human-authored text, and the selection and arrangement of our catalog are the property of Ecommerce Scale Inc. or its content suppliers and are protected by United States and international copyright laws to the extent of their human authorship. Under U.S. Copyright Office guidance, purely AI-generated artwork is not subject to U.S. copyright protection; your use of our coloring sheets is governed by the license terms below.

We grant you a limited, non-exclusive, non-transferable license to download and print our free coloring pages solely for personal, household, and classroom educational use, subject to our license agreement. You may not sell, sublicense, commercially distribute, or publish our digital files or printed pages on third-party commercial platforms.

User-submitted photographs

When you submit photographs for custom coloring books or use our creative tools, you represent and warrant that you own or have obtained all necessary licenses, rights, and permissions to use and submit the images. You agree not to upload any photograph that infringes on third-party intellectual property, violates personal privacy rights, or contains defamatory, obscene, or unlawful material.

You grant us a limited, temporary license to process your uploaded images solely for the purpose of creating your ordered custom poster, canvas, or coloring book and providing customer support. As detailed in our privacy policy, custom coloring book photos are deleted 30 days after delivery, and poster and canvas uploads, previews, and print files are deleted automatically 30 days after upload (Printful keeps the print file with your order).

Acceptable use of the website

You agree not to use the website for any prohibited purpose, including:

• Engaging in automated data scraping, harvesting, or bulk downloading without prior written consent
• Circumventing or disabling security features, authentication protocols, or bot mitigation tools like Cloudflare Turnstile
• Transmitting viruses, malware, or harmful code designed to disrupt server operations
• Using the website in any manner that could impair, overburden, or compromise site infrastructure

Disclaimers and limitation of liability

Our website, digital tools, coloring sheets, and merchandise are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by applicable law, Ecommerce Scale Inc. and its directors, employees, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the website or purchased goods. In no event shall our total aggregate liability exceed the total amount paid by you to us in the 12 months preceding the claim.

Governing law and jurisdiction

These Terms of Service and any disputes arising out of or related to your use of the website shall be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to any principles of conflicts of law.

Changes to these terms

We reserve the right to revise and update these Terms of Service at our sole discretion. Any changes will be posted directly to this page with an updated effective date. Your continued use of the website following the posting of revised terms indicates your acceptance of the changes.
